2.3 The ways in which you use PictuAI products and services, including accessing the official PictuAI website or from third-party websites authorized by us. If you did not obtain PictuAI products or services through the above-mentioned formal channels, we cannot guarantee that this version is the official version, nor can we guarantee that the AI functions of the relevant version can be used normally.IF YOU SUFFER LOSSES DUE TO THE USE OF UNOFFICIAL VERSIONS OF PICTUAI, WE WILL NOT BE LIABLE FOR ANY COMPENSATION OR INDEMNIFICATION, UNLESS OTHERWISE SPECIFIED BY LAWS AND REGULATIONS.

2.4 You need to prepare your own terminal devices such as computers, mobile phones, etc. when using PictuAI. To achieve all the functions of PictuAI, you need to connect your terminal device to the internet, and you should bear the necessary internet and data fees on your own.

2.5 We grant you a personal, revocable, non transferable, and non exclusive legal right to use PictuAI. All other rights not expressly authorized by this agreement are still reserved by us. Unless authorized in writing by us in advance, you are not allowed to use PictuAI in any unauthorized form, including but not limited to adaptation, copying, dissemination, crawling, vertical search, mirroring, or trading.

2.6 In order to enhance user experience, or based on the needs of overall service operation, platform security, and compliance management, we may periodically update or change PictuAI products or services, including but not limited to modifying, upgrading, suspending or terminating related services, providing new services, or migrating replacements. You may choose to continue using the new services or accessing our migrated new domain name as needed. IF YOU CHOOSE NOT TO CONTINUE USING THEM, SOME FUNCTIONS OF PICTUAI MAY BE RESTRICTED OR UNABLE TO FUNCTION PROPERLY. IF YOU DO NOT WISH TO USE THE UPDATED PictuAI, YOU CAN ALSO NO LONGER ACCESS IT.

3. PictuAI account

3.1 You need to register an PictuAI account according to our prompts. If you refuse to register an PictuAI account, you will not be able to use all services and functions of PictuAI.

3.2 You shall ensure that the identity authentication information you provide when registering your account is true and valid, and complies with relevant laws and regulations.IF THE IDENTITY VERIFICATION INFORMATION YOU PROVIDE IS INVALID OR FALSE, WE MAY NOT BE ABLE TO GUARANTEE THE SECURITY OF YOUR ACCOUNT ASSETS, NOR CAN WE GUARANTEE THAT WE CAN CONTINUE TO PROVIDE YOU WITH FUNCTIONS AND SERVICES RELATED TO ARTIFICIAL INTELLIGENCE CONTENT GENERATION, INFORMATION PUBLISHING, AND INTERACTIVE COMMUNICATION.

3.3 YOUR PICTUAI ACCOUNT IS FOR PERSONAL USE ONLY AND IS PROHIBITED FROM BEING GIFTED, BORROWED, RENTED, TRANSFERRED, SOLD, OR LICENSED TO OTHERS IN ANY FORM. IF WE HAVE REASONABLE GROUNDS TO BELIEVE THAT THE USER IS NOT THE ACCOUNT REGISTRANT, IN ORDER TO ENSURE ACCOUNT SECURITY, WE HAVE THE RIGHT TO SUSPEND OR TERMINATE SERVICES PROVIDED TO THE ACCOUNT.

3.4 You should maintain the security and confidentiality of your PictuAI account on your own. You shall bear legal responsibility for your actions under your PictuAI account, including but not limited to all legal liabilities that may arise from any information release, payment, or other operations you perform on PictuAI. If you lose your account, you can follow our appeal channel to apply for account retrieval in a timely manner. You understand and acknowledge that we only verify whether the verification information provided by the appellant in the appeal is consistent with the system records, and cannot identify whether the appellant is the true owner of the account.IF YOUR ACCOUNT IS STOLEN DUE TO IMPROPER STORAGE OR OTHER PERSONAL REASONS, YOU SHALL BEAR THE CORRESPONDING LOSSES ON YOUR OWN. If you discover that someone else is using your PictuAI account without permission, or if you discover any other security vulnerabilities, please notify us immediately and take appropriate measures to protect the security of your account.

3.5 You can apply to cancel PictuAI account or delete PictuAI account information at any time, but you can only apply to cancel or delete your own account and related information, and should follow the corresponding procedures to complete the verification of account ownership. After account cancellation and deletion, we will delete or anonymize the information in the account, except where laws, regulations or relevant norms have other provisions on the retention time or processing methods of information. After account cancellation and deletion, you will not be able to log in to PictuAI using that account, nor will you be able to retrieve any content or information related to PictuAI account, and you will no longer be able to continue using related services and functions. After account cancellation and deletion, you should still bear corresponding responsibility for your use of PictuAI before canceling and deleting PictuAI account.

4. User behavior norms

4.1 You acknowledge and undertake that in the process of using PictuAI, you shall respect privacy and ethics, and pay attention to protecting data security. You shall not input or share any unauthorized personal information, confidential information (including but not limited to trade secrets), or other types of unauthorized information; You should respect the legitimate rights and interests of others, ensure that your input content is legal and compliant, owned by yourself or has obtained legal authorization, and shall not input or share any unauthorized content, nor infringe on the copyright, patent, trademark, portrait, name, sound, reputation, honor and other rights of others. You are not allowed to use PictuAI to impersonate others and engage in illegal activities such as infringement. You are also not allowed to use new technologies and applications based on deep learning, virtual reality, and generative artificial intelligence to generate, produce, publish, or spread rumors, false information, and other illegal content.

4.2 When you generate, produce, publish, or disseminate non real information or other information content that may cause confusion or misidentification to the public (hereinafter referred to as "AI content") based on new technologies and applications such as deep learning, virtual reality, and generative artificial intelligence, we have the right to add appropriate labels in accordance with relevant laws, regulations, and mandatory national standards; At the same time, please carefully read and understand the labeling management requirements in relevant laws, regulations, and mandatory national standards. Do not block, smear, modify, or delete the labeling we have added to AI content in any way. Please understand and note that if you fail to add explicit labeling on AI content as required by laws and regulations, resulting in confusion or misidentification among the public, you will be solely responsible for any consequences and liabilities arising therefrom.

4.3 We are committed to providing a civilized, rational, friendly, and high-quality service platform. After completing the authentication of your real identity information in accordance with regulations, you can use PictuAI to generate images, create images, modify images and other information content, and ensure that the information content entered, generated, published or disseminated (whether public or not) complies with legal and regulatory requirements. If you generate, publish or disseminate information related to domestic and foreign current events, public policies, social events and other related matters, you should accurately label the source of the information.

4.4 You are not allowed to input, generate, produce, copy, publish, or disseminate the following illegal and irregular content:

(1) Opposing the basic principles established by the Constitution;

(2) Endangering national security, leaking state secrets, subverting state power, and undermining national unity;

(3) Damaging national honor and interests;

(4) Distorting, vilifying, desecrating, or denying the deeds and spirit of heroes and martyrs, and insulting, slandering, or otherwise infringing upon their names, portraits, reputations, and honors;

(5) Promoting terrorism, extremism, or inciting the implementation of terrorist or extremist activities;

(6) Promoting ethnic hatred, ethnic discrimination, and undermining ethnic unity;

(7) Disrupting national religious policies, promoting cults and feudal superstitions;

(8) Fabricating, spreading rumors, false information, disrupting economic and social order, and disrupting social stability;

(9) Spreading or disseminating obscenity, pornography, gambling, violence, murder, terrorism, or inciting crime;

(10) Insulting or slandering others, infringing on their reputation, privacy, portrait, intellectual property or other legitimate rights and interests;

(11) Commercial advertisements that violate laws and regulations related to Internet advertising;

(12) Other content prohibited by laws and administrative regulations.

4.5 You shall not input, generate, produce, copy, publish, or disseminate the following harmful content, and shall actively resist the dissemination of such content:

(1) Using exaggerated titles that do not match the content of the title;

(2) Spreading rumors, scandals, and bad deeds;

(3) Improper evaluation of natural disasters, major accidents, and other disasters;

(4) Those with sexual implications, teasing, or other factors that can easily trigger sexual associations;

(5) Showing blood, horror, cruelty, and other physical and mental discomfort;

(6) Instilling discrimination against groups, regions, etc;

(7) Promoting vulgar, vulgar, and pandering content;

(8) May trigger minors to imitate unsafe behavior and violate social ethics, induce minors to have bad habits, etc;

(9) Those who engage in violent intimidation or threats towards others, and commit acts of online violence;

(10) Spreading vulgar language and damaging social order and good customs;

(11) Other content that violates laws and regulations, public policies, public order and good customs, or may interfere with our normal operations and infringe upon the legitimate rights and interests of other users or third parties.

4.6 You shall not input, generate, produce, copy, publish, or disseminate content that is deceptive, highly dangerous, or harmful to the physical and mental health of performers or others

(1) Any fraudulent, deceptive or misleading content;

(2) Any content of violent and/or self injurious behavior;

(3) Any threat to life and health, performance using dangerous equipment, or performance methods that may endanger one's own or others' personal and/or property safety;

(4) Encouraging or inducing others to participate in dangerous activities that may cause personal injury or death.

4.7 You are not allowed to input, generate, produce, copy, publish, or disseminate information that disrupts the platform's business order, including but not limited to junk information, commercial solicitation information, excessive marketing information, information unrelated to the content being commented on, and information that deliberately uses character combinations to evade technical review.

4.8 If we have reasonable grounds to believe that your behavior violates or may violate the above agreement, we have the right to take measures, including but not limited to warning reminders, restricting account functions, suspending or terminating all or part of PictuAI's services to you without prior notice, and holding relevant parties legally responsible in accordance with the law.

5. Network security protection

5.1 You shall not use any plugins, plug-ins, systems, or third-party tools to interfere with, disrupt, modify, or otherwise affect the normal operation of PictuAI, including but not limited to using any automated programs, software, or similar tools to access PictuAI, collect or process information and content therein.

5.2 You shall not engage in any behavior that endangers the security of PictuAI website system, nor shall you use PictuAI to engage in any behavior that endangers computer network security. Such actions include but are not limited to:

(1) Activities that endanger network security, such as illegal intrusion into the network, interference with normal network functions, and theft of network data;

(2) Provide programs and tools specifically designed for activities that pose a threat to network security, such as intrusion into networks, interference with normal network functions and protective measures, and theft of network data;

(3) Providing technical support, advertising promotion, payment settlement, and other assistance to others who knowingly engage in activities that endanger network security;

(4) Using unauthorized data or accessing unauthorized servers or accounts;

(5) Unauthorized access to public computer networks or other people's computer systems and deletion, modification, or addition of stored information;

(6) Attempting to explore, scan, or test vulnerabilities in the PictuAI website system or network without permission, or engaging in other activities that undermine network security;

(7) Attempting to interfere with or disrupt the normal operation of PictuAI website system or website, intentionally spreading malicious programs or viruses, and other behaviors that disrupt and interfere with normal network information services;

(8) Falsifying TCP/IP packet names or partial names;

(9) Reverse engineer, disassemble, compile, or otherwise attempt to discover the source code of PictuAI website;

(10) Malicious registration of PictuAI account, including but not limited to frequent and bulk account registration;

(11) Other behaviors that may endanger the computer network security of PictuAI website or other platforms.

5.3 Without our written permission, no user or third party shall, on their own or with the assistance of others, engage in the following actions regarding the information or content on PictuAI website:

(1) Using information or content from PictuAI website for the purpose of promoting one's own products, increasing user base for one's own products, confusing the relationship between one's own products and PictuAI, and engaging in unfair competition;

(2) Unauthorized editing, organizing, or adapting of information or content on PictuAI website, and displaying it on channels or platforms other than the source page of PictuAI;

(3) Using technical means or special identification methods to modify, hijack, redirect, obstruct, insert, pop up, or engage in other behaviors that prevent users from using PictuAI website normally;

(4) Stealing, monitoring, copying, disseminating, displaying, mirroring, uploading, downloading, and using information or content from PictuAI website through any improper means such as chain stealing, redundant theft, crawler crawling, simulated downloading, deep linking, and fake registration;

(5) Using or disseminating information or content in PictuAI by hiding or modifying PictuAI domain name, PictuAI logo, PictuAI user information, etc;

(6) Using unauthorized access to information or content from PictuAI website for statistical purposes such as hot keywords, hit rates, classifications, search volume, click through rates, reading volume, usage, etc;

(7) Use the information or content on PictuAI website for any form of sales and commercial use beyond our written authorization, or provide or allow third-party use in any form;

(8) Interference with information or content related data on PictuAI website, including affecting content usage and playback, tampering with PictuAI data, etc;

(9) Develop, provide or operate products, models or services that compete with PictuAI by utilizing PictuAI products and services, information or content on PictuAI website;

(10) Other illegal activities of obtaining or using information or content from PictuAI website.

5.4 If we have reasonable grounds to believe that your actions violate or may violate the above agreement, or if you have other actions that have adversely affected PictuAI's information and content, or caused damage to the rights and interests of PictuAI's users, we have the right to take action, including terminating the provision of services to you without prior notice, and holding relevant parties legally responsible in accordance with the law.

6. Complaints and reports

6.1 We support public complaints and reports. You can complain and report any behavior or content that violates laws, regulations, or the provisions of this agreement to us at any time. We will promptly accept and handle your complaints and reports to jointly create a clean and upright online space.

6.2 If you find any content on PictuAI website that violates your rights, you can contact us using the contact information displayed on this website and provide evidence of your rights. We will promptly handle your complaint in accordance with relevant laws and regulations. If your content on PictuAI website is complained about by relevant rights holders for infringement and processed, and you do not agree with the processing results, you can also submit a non infringement statement and relevant proof of rights materials to us for appeal. We will also handle your appeal in a timely manner in accordance with relevant laws and regulations.

7. Default handling

7.1 If you violate the provisions of this agreement, including platform rules, we have the right to take pre warning, refuse to generate and publish, immediately stop transmitting information, delete content, temporarily prohibit the publication of content or comments, restrict some or all functions of the account, until the provision of services is terminated, the account is permanently closed, re registration is prohibited, and other disposal measures stipulated by laws and regulations are taken. For any adverse consequences caused by this, such as the unavailability of PictuAI functions, deletion of account information, deletion of content, and inability to obtain assets or other rights in your account, you shall bear them on your own. We reserve the right not to recover deleted user information or content.

7.2 If you participate in the prize sales activities organized by PictuAI website through improper or cheating means, we have the right to restrict or cancel your eligibility to participate in the activities, cancel or withdraw the rewards. If you have already received the reward, we have the right to request that you return the prize or cash of equivalent value.

7.3 We have the right to announce the processing results and decide whether to restore the use of relevant accounts based on the actual situation. We will keep relevant records of suspected illegal and criminal activities, and have the right to report to the relevant competent authorities and cooperate with their investigations in accordance with the law.

9. Intellectual Property

9.1 All intellectual property rights of the products and services on PictuAI website belong to us, including but not limited to software, technology, programs, web pages, text, images, audio, video, charts, layout design, electronic documents, etc., except for those rights that the relevant rights holders should enjoy according to legal provisions. The copyright, patent rights, and other intellectual property rights of the software on which we provide PictuAI's products and services belong to us, or we have obtained valid authorization.

If you do not wish us to use it for the aforementioned purposes, you can contact us to explain.

9.4 In order to better share and promote your work, enhance its dissemination value and influence, you grant us a global, free, non exclusive, and multi-level sublicensable right to the information content you publish through PictuAI, including the right to modify, copy, translate, compile, disseminate through information networks, adapt, and produce derivatives, performances, and displays. The scope of use of the above rights includes the use on PictuAI or other websites, applications, or smart terminal devices and other products. You agree that we have the right to use or license third parties to use the aforementioned content or any promotion, advertising, marketing, and/or research related to us, and may also develop all or part of such content through other means. The rights granted above include the right and license to use, copy, and display the personal image, likeness, name, trademark, service mark, brand, name, logo, and company mark (if any) that you own or are licensed to use and embed in the content, as well as any other brand, marketing or promotional assets, materials, materials, etc.

9.7 We provide technical support for the development and operation of PictuAI, and have full rights to all data and information generated during the development and operation of PictuAI within the scope permitted by laws and regulations.

9.8 Please do not use, remove or tamper with any trademarks, service marks, trade names, domain names, website names or other PictuAI brand logos (collectively referred to as "logos") related to this website or PictuAI logo under any circumstances. Without our prior written consent, you are not allowed to display, use, or apply for registration of trademarks, domain names, or any other means of displaying, using, or otherwise dealing with the aforementioned logos, either alone or in combination with them. You are also not allowed to engage in any behavior that expressly or implicitly grants others the right to display, use, or otherwise handle such logos. 10. Taxation

You understand and agree that when we withhold and pay taxes or handle tax declarations on behalf of tax authorities, we may need to collect or use your personal information and tax related materials. You should cooperate with us to actively fulfill your tax obligations.

11. Special agreements regarding individual services and third-party services

11.1 The PictuAI website contains information or links to information content that we obtain through various legal means, as well as other individual services that we operate legally. These services may exist as separate sections in PictuAI. We have the right to increase, decrease, or change the settings and services of these special sections from time to time.

11.2 You can enable and use the above-mentioned individual service functions on the PictuAI website. Some individual services may require you to simultaneously accept agreements or other rules specifically formulated for that service that bind you and the service provider. You understand and confirm that this payment service is provided to users by a third party with legal qualifications. In addition to being bound by this agreement, it is also subject to the terms and policies of the third-party payment service provider and financial institutions. The conditions and standards for the use of such payment services shall be determined by you and the payment service provider.

11.5 If you use financial services including but not limited to third-party payments on PictuAI website, please carefully understand the content of such services, fully read and agree to the relevant agreement terms.

12. Terms of Use for Minors

The main target audience for PictuAI is adults. If you are a minor under the age of 18, you should carefully read this agreement under the guidance of your guardian. After obtaining the consent of your guardian, you can use PictuAI. If you do not obtain the consent of your guardian, the guardian can notify the platform through the platform's public channels to process the relevant account. The platform has the right to restrict the functions of the relevant account (including but not limited to browsing, AI content generation, posting information, interactive communication, etc.).

12.2 We attach great importance to the protection of personal information and privacy of minors. We would like to remind you to strengthen your awareness of protection and be cautious when using and publishing content containing materials about minors when filling in their personal information. You shall obtain all legal authorization and consent to use and display the portrait, voice, and other information of minors, and allow us to use and process such content related to minors in accordance with this agreement.
